Terms of Service

These terms are an agreement between you and Futsy (“we”, “us”, “our”), operated from Melbourne, Victoria, Australia. They govern your use of the Futsy web app and website — a platform for organising futsal leagues: fixtures, teams, RSVPs, substitute matching, results and ladders.

By creating an account or using Futsy you agree to these terms and to our Privacy Policy, which explains how we handle your personal information.

We have written these terms in plain English on purpose. Nothing in them excludes, restricts or modifies any right you have under the Australian Consumer Law that cannot lawfully be excluded — see Section 10 first if you read nothing else.

1. What Futsy is (and is not)

Futsy is league management software. We provide the scheduling, team management, RSVP, substitute-matching, results and communication tools that leagues run on.

Futsy is not the organiser of your competition and not the operator of the venue where you play. Your league is run by a league operator — a venue, club or organiser who uses Futsy to administer it. The league operator, not Futsy, is responsible for:

When you play futsal, you are participating in a physical sport organised by your league operator at their venue. Any waiver, insurance arrangement or injury policy for the games themselves is between you and the operator or venue.

2. Eligibility and your account

You must be 18 or older to use Futsy. That applies to every way in: creating an account, signing in, accepting an invitation, joining a league or a team, being listed as a player, captain, referee or administrator, and submitting anything through the service. There is no parental or guardian consent that changes this. If you are under 18 you may not use Futsy, and nobody may use it on your behalf.

This is a limit on what Futsy is today rather than a view about junior futsal. Running a junior competition properly takes age verification, guardian consent records, age-appropriate design and child safeguarding controls that this version of Futsy does not have and does not pretend to have. If we ever offer a youth product it will be under separate terms, a separate privacy notice and its own safeguards. We are not promising to build it and we are not saying when.

By creating an account or using Futsy, you represent that you are 18 or older.

Your account

Roles. Depending on how your league is set up you may be a player, a team captain, or a league administrator. Captains and administrators get access to other players’ contact details and team management tools; if you hold one of these roles, you must use that access only to run your team or league — not for marketing, scraping or any unrelated purpose.

If you run a league

League operators, administrators and team captains carry this rule for everyone they add. You must not create an account for, invite, import, register, or keep a profile for anyone under 18 — not through an individual invitation, a team join link, a roster or season import, an approved registration, or any other route. A parent’s or guardian’s permission does not make it permitted.

When you invite someone or upload their details, you represent that every person whose personal information you provide is 18 or older and that you are authorised to give us that adult’s information for the purpose of running your competition.

If a minor gets in anyway

Tell us. Email privacy@futsy.app or support@futsy.app if you believe an account or a player record on Futsy belongs to someone under 18 — whether it is yours, your league’s, or someone else’s. You do not need to be certain.

Where we reasonably believe an account or a player record concerns a person under 18, we may restrict or suspend access to it while we look into it, and we may delete or de-identify the information. We will use what we hold only so far as is reasonably necessary to investigate, to protect the person involved, to meet a legal obligation, and to remove or de-identify it. We will not promise instant erasure everywhere, because that is not something any service can honestly promise: some records sit with our providers, some are held for the periods set out in Section 5 of the Privacy Policy, and backups expire on their own schedule. What we do undertake is that we will not keep or use it for anything else.

3. Acceptable use

You must not:

Content you submit. Futsy involves limited user content: your profile details, notes on substitute requests, and results entries. You keep ownership of what you submit and grant us a non-exclusive, royalty-free licence to store, display and process it as needed to run the service (for example, showing your name on a fixture). We may remove content that breaches these terms.

Reporting. In the Futsy app there is a Report control on the content itself: on a team name, on a note attached to a fill-in request, and on a player profile. On this website the Report control is on fill-in notes. Anywhere else, including anything only a league administrator can see, there is no Report control to tap — email support@futsy.app instead and tell us what you saw. Reports made either way get the same attention.

A report made through the app or this website goes to your league’s administrators, who can remove the content. An email comes to Futsy and we act on it ourselves. We look at both within 24 hours. We remove content that breaches these terms, and where a breach is serious or repeated we can revoke an account’s access or close it. Your league’s administrators can edit or remove the content and remove someone from a team; anything to do with the account itself is ours.

Blocking. Block is on a player’s profile in the app. It keeps the two of you apart in fill-in requests: you will not see spots they post, they cannot apply for yours, neither can be approved for the other’s, and neither of you is notified about the other. Our database enforces that, not just the screen. It is not a general hiding of everything they have written, and fixtures, results, the ladder and squad lists do not change — blocking keeps someone out of your way, it does not rewrite the competition. The person blocked is not told.

Some wording is refused outright at the point of writing, on every field one person writes and another reads, so it never reaches anyone. That filter is a floor rather than a substitute for reporting: it catches specific slurs, not context, and harassment that uses ordinary words needs a person to look at it.

Where we cannot show who wrote something — a team name and a profile can both be edited by a league administrator — we record no author and act on the content rather than naming someone who may not have written it.

5. Fees, payment and refunds

For league operators. Futsy is offered as a paid subscription, billed in Australian dollars through our payment processor, Stripe. By subscribing you authorise recurring charges to your nominated payment method at the interval shown at checkout, until you cancel.

For players. Player accounts are free. If your league operator charges you to play, that fee is set, collected and refunded (or not) by them under their own terms — Futsy is not a party to it.

Chargebacks: if you dispute a charge with your bank instead of contacting us first and the charge was valid, we may suspend the account involved while it is resolved. Please talk to us first — genuine billing errors get refunded faster than a chargeback resolves.

6. Service availability

We aim to keep Futsy available and working, and we monitor errors and outages. But we are a software service, not a utility: we do not promise uninterrupted or error-free operation, and we may need to take the service down briefly for maintenance (scheduled maintenance will be done outside peak fixture hours where practicable). This clause does not limit your Australian Consumer Law guarantees — a service that fails to meet them attracts the remedies in Section 10 regardless of what this paragraph says.

7. Your data

Your personal information is handled as described in our Privacy Policy, including your rights to access, correct, export and delete it. Two points worth repeating here:

If you close a league operator subscription, we will make the league’s data available for export for 60 days after the subscription ends, after which we may delete it.

8. Suspension and termination

We may suspend or terminate your account if you materially breach these terms — for example harassment, results manipulation, misuse of other players’ contact details, or attempts to compromise the service. For anything short of serious or dangerous conduct, we will warn you and give you a chance to respond before terminating.

Appeal: if your account is suspended or terminated and you believe we got it wrong, email us within 30 days. A human will review the decision and reply with reasons.

You may stop using Futsy at any time. Players can delete their account in-app; operators can cancel their subscription as described in Section 5. On termination, Sections 3 (content licence, limited to existing league records), 7, 10 and 11 continue to apply.

We will never terminate an operator’s account without cause and without notice — if we ever discontinue Futsy entirely, we will give operators at least 60 days’ notice and a full data export, and refund any pre-paid period we don’t deliver.

9. Intellectual property

Futsy — the software, design, name and logo — belongs to us. We grant you a personal, non-transferable licence to use it for organising and playing in futsal competitions while these terms apply. You must not copy, resell, or offer Futsy (or data extracted from it) as your own service. Feedback you send us can be used to improve the product without obligation to you.

10. Australian Consumer Law and liability

Your consumer guarantees are untouched. Under the Australian Consumer Law, our services come with guarantees that cannot be excluded: they must be provided with due care and skill, be fit for the purpose we advertise, and be delivered in a reasonable time. Nothing in these terms excludes, restricts or modifies those guarantees or your remedies for their breach.

Where the law allows us to limit liability (which, for services not of a kind ordinarily acquired for personal use, the ACL permits under s 64A), our liability for a failure is limited, at our option, to resupplying the service or paying the cost of having it resupplied. This limitation does not apply where it would be unfair or where the failure is a major failure under the ACL.

What we are responsible for: the Futsy software doing what we advertise, handling your data as our Privacy Policy states, and processing operator payments correctly.

What we are not responsible for (because they are outside our control and are the league operator’s or venue’s domain): injuries or incidents during games, venue conditions, refereeing and competition decisions, fees charged by operators, and the conduct of other players — though we will act on reports of platform-based misconduct as described in Section 3.

Neither of us is liable to the other for consequential loss (lost profits, lost opportunity) except where the ACL or other law says otherwise. Nothing in these terms limits liability for fraud, or for death or personal injury caused by our own negligence.

11. Governing law and disputes

These terms are governed by the laws of Victoria, Australia, and disputes are subject to the non-exclusive jurisdiction of the courts of Victoria.

Before going to a court or tribunal, contact us — most problems are billing or account issues we can fix in days. If we can’t resolve a dispute between us within 30 days of you raising it, either of us may pursue it formally. Consumers in Victoria can also contact Consumer Affairs Victoria (consumer.vic.gov.au, 1300 558 181) or bring eligible claims in VCAT. Nothing in this section prevents you from complaining to the OAIC about privacy (see the Privacy Policy) or exercising any statutory right.

12. Changes to these terms

We may update these terms as the product evolves. For material changes — anything affecting fees, your rights, liability, or how disputes work — we will give you at least 14 days’ notice by email and in-app before they take effect, and for operators no fee-related change will apply until your next billing period. If you don’t agree with a change, stop using the service (and cancel any subscription) before it takes effect; we’ll refund any pre-paid unused period affected by a material change you reject. Minor clarifications take effect on posting. Previous versions are available on request.

If any part of these terms is found invalid, the rest still applies. These terms plus the Privacy Policy are the entire agreement between us about the service, except that nothing here overrides your non-excludable statutory rights.
